Can I sue someone for using my photo?

I have seen that someone is using my pic on orkut can I sue him for using my photo or what should I do to remove this photo from his profile?

You can report the user to the site admin with regards to his abuse. I think that's the farthest you can go. A lot of people do grab other people pictures. Best thing you should do with this kind of thing is to protect your pictures. Make them grab proof.
