Can we use models picture from her personal site to our site? If no then what should I do legally to do it?

You need a permission first before posting it on the site. It's invasion of one's privacy if you will just do it without asking any permission.

I just wonder than how can one start wallpaper site for the models. Does laws do not apply on them?

I think the wallpaper with those models is depends on the situation, if the wallpaper itself is come out from the legal site, it shouldn't be problems, but if someone just modify the model pictures and put them in together to promote some products, then it is in big legal issues.

You cannot just use the pictures. Even free stock images sometimes have to have a model's release form obtained by the photographer before they can hand them over for stock image use. Photographers normally do this as a matter of course but you need to check the site's TOS on usage.

For example stock.xchng, which is one of the most popular stock image sites, says:

Since SXC does NOT require a written Model Release for each Image that has identifiable people on it, We cannot guarantee that you will be able to use the Image for any purpose You like. Also, if there is a model release for the Image, We do not represent or make warranties whatsoever as to the legality or validity of it.

So even when you don't need a model release, it still doesn't mean do anything you want. The main reason being in case the model finds your site objectionable eg if they were a Christian and their picture was used on a site promoting atheism.

If in doubt, don't use it. You can't just steal a model's pictures for your own use. Not getting a reply isn't reason enough to go ahead unless you want to be sued and saying where you got them doesn't matter either if the other site also used them without permission. All that does is get you both sued. It's not a get out of jail free card to say he did it first.

Ask and wait for an answer or look at the site's TOS to see whether it says you are free to use them.

you may use the picture, copy the image location from the site and post here click on image and paste the url then post it,
